We want to thank everyone who attended the DPHHS hearing in Helena regarding the new proposed rules. We want to especially thank those that stood up and represented our community with their words to the department. It's so important that in situations where the department has opened the floor to listen to us, we take advantage of the opportunity. Again thank you so much to those who came to speak to protect the businesses who must operate under these rules, and ultimately protect the patients in our medical program.

This week on the 20th the Montana DPHHS meets in Helena to receive public comment and review the newly proposed rules for the medical marijuana industry. These new rule changes include restrictions to the types and sources of CBD you may sell as a licensed provider, changes in fees, and a complete ban of any form of advertising for the community. These new rules would make Montana the most censored medical marijuana program in the US. Under the proposed rules, the definitions for what is considered a prohibited activity has been extended to “the use of any written or verbal statements, photos, symbols, or depictions of marijuana or marijuana products, that is on any medium accessible to the general public” (RULE I, Proposed Rules Package, Medical Marijuana Program DPHHS.)

These new rules will completely cripple the industry’s ability to convey any information to the general public and harm the accessibility of adults to gain access to much-needed information in order to make educated decisions about our medical marijuana program. These rules may even constitute a breach of the right to “Commercial Speech” provided by the First Amendment. Instead of protecting the general public and minors from malicious or misrepresentative advertising, these proposed rules will remove any ability for a business to even communicate what it does.

This month is the Big Sky Documentary Film Festiva

This month is the Big Sky Documentary Film Festival, one of Missoula’s largest film festivals focused on the Society, the Environment, Art and Culture. The festival is from February 14th through the 23rd with screening all over the city. On February 15th is going to be the “Story of Plastic” by Deia Schlosberg, this film explores the history and dependence on plastic by our society over the last century and sheds light on some of the most concerning global aspects of this crisis and what possibility the future holds. With this wave of hemp-based products sweeping across the US, hemp has begun to be touted as the fix to some of the greatest problems of the 21st century, including improving our health and solving the crisis with non-biodegradable plastics. Although it is very easy to find multiple articles on the health and medicinal properties of cannabinoids and many of the compounds found in the flower of the Cannabis genus, there is undoubtedly a push to make cannabis into some kind of a cure-all for ailments. The push to paint hemp as the savior of our single-use plastics problem that is choking the oceans, clogging the rivers, and languishing in our landfills will only delay taking real actions to mitigate this issue.

The DPHHS announced its notice of intent to begin

The DPHHS announced its notice of intent to begin enforcing Emergency Rules that temporarily restrict the sale of flavored e-cigarette products in Montana. DPHHS is proceeding with the enforcement of the rules, citing that the Temporary Restraining Order preventing enforcement expired by operation of law in October.

On October 8, 2019, the Montana Department of Public Health and Human
Services issued Emergency Rules to temporarily restrict the sale of flavored e-cigarette products in Montana. On October 18, 2019, the Court issued a Temporary Restraining Order and Order to Show Cause which temporarily suspended enforcement of the emergency rules. The Court set a hearing on Petitioners' Application for a Preliminary Injunction. The hearing was held on October 30 and November 1, 2019.

Citing Mont. Code Ann. § 27-19-316(4), the department claimed that the October 18 Temporary Restraining Order expired after ten days. Since the Emergency Rules were first announced, DPHHS has confirmed five additional cases of E-cigarette or Vaping Product Use Associated Lung Injury (EVALI) in Montana. Though the State has thus far declined to enforce the Emergency Rules pending resolution by the Court, it reasons that imminent threats to public health and safety that precipitated the rules are ongoing and demand a public health response.

A mixture of plummeting hemp prices and a lack of possessors has led to a very unstable market where many are losing thousands. A combination of sketchy buyers and unfulfilled deals has lead many hemp growers and brokers to become very wary of who buys their flower. Unpaid deals and hostile LEO sniping transcontinental shipments of hemp has caused some farmers to declare bankruptcy. So what can we do to help?
